Court Marriage: A Simple, Secure & Legally Recognized Union
What Is a Court Marriage?
Court marriage is a legally recognized form of marriage solemnized under the Special Marriage Act, 1954, providing couples with a lawful, transparent, and secular alternative to traditional marriage ceremonies. It is particularly suitable for inter-religious, inter-caste, or choice-based marriages requiring legal certainty and nationwide validity.
Legal Framework Governing Court Marriage
A court marriage is conducted before a Marriage Officer after compliance with statutory requirements, including submission of a notice of intended marriage, verification of documents, and appearance of both parties along with witnesses. The Act mandates a 30-day notice period, during which objections—if any—are examined strictly on legal grounds.
Eligibility & Essential Requirements
To solemnize a court marriage, both parties must be legally eligible:
Minimum age of 21 years for the groom and 18 years for the bride
Free and valid consent Absence of prohibited degrees of relationship (unless permitted by custom) Registration & Legal Validity Upon completion of the statutory process, the marriage is solemnized and registered, and a Marriage Certificate is issued. This certificate serves as conclusive legal proof of marriage for all official, immigration, and legal purposes across India.
